South Africa’s Constitutional Court has won international acclaim for its
erudite judgments that have made it a strong pillar of the country’s
constitutional democracy and protection of people’s rights. But question
marks hang over the court due to some serious governance failures and
errors of judgment in recent times, suggesting that all is not well at the
apex court. These concerns will be top of mind when consideration is given
to the appointment of a new chief justice of the court to succeed the
current incumbent, Mogoeng Mogoeng. Richard Calland outlines

Earlier this month former Chadian leader Hissène Habré passed away in jail
in Senegal while serving a life sentence for war crimes, crimes against
humanity and torture committed while he was in power from 1982 to 1990. The
unprecedented trial and Habré’s conviction were hailed as a landmark moment
for African justice. The tribunal that tried him represented Africa’s first
locally produced international criminal law, its first application of
universal jurisdiction, and its first judicial challenge to a former
