One university went back to transactional licensing a year ago and they have saved hugely. If the Bill is enacted, we won't need to have a licence with Dalro as coursepacks are included in the provisions.
What was very worrying is that Dalro's seminar last year was a totally anti Bill agenda. So many librarians who attended had not even read the Bill and were all supporting the anti Bill presentations. I told them during breaks, that they need to read the Bill and know what excellent exceptions there are for libraries, education etc. Many of them were surprised. That ls indeed worrying!!!
I made a lot of input into the Bill related to exceptions and they were from international documents, treaties, Eifl model copyright law, research findings, etc. We really need this Bill urgently. Draft Regulations still have to be published then before the Bill will be fully implemented.

Regarding the Bill, we continue to lobby for President to sign. I have even written to and tweeted his office many times and got various organisations to write to him. BlindSA and Creative Commons did so recently. See all the statements and letters at

Unfortunately some organisations previously made submissions but are now quiet on the matter. We need to keep up the pressure on the President especially in this lockdown period. Show him that had he signed the Bill, access to information and placing material online, would not be so problematic for schools and tertiary institutions.
We need LIASA to keep up the heat on this matter too. Perhaps they can support EIFL and others who have signed the letter to the WIPO Director. I sent it out to various people recently.
Individual librarians can also be more verbal on this issue. Unfortunately only a few librarians and academics have been fighting this battle. One person said the President had said that he needs to see a lot more support for the Bill locally, before he considers signing it. This was about 6 months ago.
What individuals can do is tweet the Presidency and the President himself expressing the urgency of signing the Bill.
We really have to step up the game!

For years they have been double dipping. We have paid exorbitant prices for the resources and then to make them more accessible to our staff and students on a password protected electronic platform we have to pay high charges to Dalro. They take an admin fee of 25 to 30% before even distributing the money, the bulk of which flows out the country.
I wrote to all publishers of our e-resources and the majority of them, including some of the big 5, allow print and or electronic course- packs without going to Dalro. In fact we sent the schedule to Dalro and it's now an annexure to our Blanket Licence. Sincs we have unnecessarily signed non disclosure agreements, I can't share this information, but I suggest you do the same.
Also, since we are tied to a Blanket licence, we are paying far too much as we have reduced photocopies substantially as we refer our users to the title and link rather than provide full text, and to open access resources.

We have already paid for this material, what informs the rate they are using bearing in mind that its only for a limited period. For example the annual rate is R1,07. All our electronic materials are under strict university-wide and can be accessed remotely only by bona fide university students. We have invested a lot of money in sourcing Virtual Protected Network and Proxy systems precisely for that reason, and why should we now pay extra for something we have access to it anyway. If what you are saying is true, then it is not assistance. I thought this assistance was to allow us for a limited period to be able to upload the content for FREE.(we still have to spend money in digitizing)
3) Ancillary materials normally made available to lecturers: These materials can be made available to students on the university learning materials system for use by lecturers in audio-visual tutorials and teaching sessions or distance education sessions. Why should we pay for something that we already own, that is my question. You must also remember that some of these ancillary materials Lecturers add value to them so its not purely their content.

I interpret the letter differently. It highlighted the agreement that supports universities during this period in that they "may need to reproduce licenced works beyond the DALRO-mandated limit". There is definitely no double-dipping, but an extension to include larger portions of materials, and possibly materials not normally included. The way we, as Rhodes University Library interpreted it, includes the following provisions that DALRO and PASA made:
1) Frequently used materials (often short-loan materials) only available in print format and of which the university has lawfully acquired print copies can be digitised, provided no online alternative is available. Under these circumstances, universities may apply to DALRO on a case-by-case basis to make digitised copies of such print materials and host them on the normal university infrastructure within the normally permitted limits, where such infrastructure now also allows remote access to affiliated students.

This DALRO letter seems to be misleading. It creates an impression that DALRO & PASA are making an offer to libraries to upload the content to trusted LMS for free for a limited period to assist with learning off-campus. In actual fact, when you apply to do precisely that, you are then given a quotation. Why the double-dipping? Since we have already paid for the resources, and some institution has already paid to the reproduction of course packs, and now we are expected to pay when we want to upload the same content that we have paid for in our LMS.
Maybe its time that we put pressure on the President to sign the Copyright Amendment Act. This is getting out of control with these companies taking advantage of the situation.
I think this is just plain exploitation of public institution during this difficult time, and maybe we also need to report this to the relevant government department

Regarding the Bill, we continue to lobby for President to sign. I have even written to and tweeted his office many times and got various organisations to write to him. BlindSA and Creative Commons did so recently. See all the statements and letters at

Unfortunately some organisations previously made submissions but are now quiet on the matter. We need to keep up the pressure on the President especially in this lockdown period. Show him that had he signed the Bill, access to information and placing material online, would not be so problematic for schools and tertiary institutions.
We need LIASA to keep up the heat on this matter too. Perhaps they can support EIFL and others who have signed the letter to the WIPO Director. I sent it out to various people recently.
Individual librarians can also be more verbal on this issue. Unfortunately only a few librarians and academics have been fighting this battle. One person said the President had said that he needs to see a lot more support for the Bill locally, before he considers signing it. This was about 6 months ago.
What individuals can do is tweet the Presidency and the President himself expressing the urgency of signing the Bill.
We really have to step up the game!

Hi All,
For years they have been double dipping. We have paid exorbitant prices for the resources and then to make them more accessible to our staff and students on a password protected electronic platform we have to pay high charges to Dalro. They take an admin fee of 25 to 30% before even distributing the money, the bulk of which flows out the country.
I wrote to all publishers of our e-resources and the majority of them, including some of the big 5, allow print and or electronic course- packs without going to Dalro. In fact we sent the schedule to Dalro and it's now an annexure to our Blanket Licence. Sincs we have unnecessarily signed non disclosure agreements, I can't share this information, but I suggest you do the same.
Also, since we are tied to a Blanket licence, we are paying far too much as we have reduced photocopies substantially as we refer our users to the title and link rather than provide full text, and to open access resources.

If what you are saying is true, then it is not assistance. I thought this assistance was to allow us for a limited period to be able to upload the content for FREE.(we still have to spend money in digitizing)
3) Ancillary materials normally made available to lecturers: These materials can be made available to students on the university learning materials system for use by lecturers in audio-visual tutorials and teaching sessions or distance education sessions. I interpret the letter differently. It highlighted the agreement that supports universities during this period in that they "may need to reproduce licenced works beyond the DALRO-mandated limit". There is definitely no double-dipping, but an extension to include larger portions of materials, and possibly materials not normally included. The way we, as Rhodes University Library interpreted it, includes the following provisions that DALRO and PASA made:
1) Frequently used materials (often short-loan materials) only available in print format and of which the university has lawfully acquired print copies can be digitised, provided no online alternative is available. This DALRO letter seems to be misleading. It creates an impression that DALRO & PASA are making an offer to libraries to upload the content to trusted LMS for free for a limited period to assist with learning off-campus. In actual fact, when you apply to do precisely that, you are then given a quotation. Why the double-dipping? Since we have already paid for the resources, and some institution has already paid to the reproduction of course packs, and now we are expected to pay when we want to upload the same content that we have paid for in our LMS.
Maybe its time that we put pressure on the President to sign the Copyright Amendment Act. This is getting out of control with these companies taking advantage of the situation.
I think this is just plain exploitation of public institution during this difficult time, and maybe we also need to report this to the relevant government department
