[Irtalk] SA Copyright Office Database?

Dear Michelle, Kataila and Denise

Thank you so much for your input. Sandy Thatcher posted the following on a mailing list:

There is a simple way to find out who owns the copyright. Check with the Copyright Office.

The above applies to the USA or UK (Denise indicated there is such a database in the UK)). That made me wonder whether SA has made any progress in terms of such a database.  Currently we do all the following to establish the copyright for research articles:

-          SHERPA RoMEO

-          Publisher & journal web page policies

-          Author agreement with publisher

-          Consult with SU IP Office

-          Create awareness re OA and addenda that can be attached; negotiate for archiving of second copy on IR

-          Etc

Maybe this is something there is a need for if none of the DHET , Dept of Trade and Industry, DALRO etc keeps an openly accessible registry. Would be a huge task, but would be incredibly helpful for all!

I checked on this with the IP Law Unit at UCT and received the following response...

As far as I know there is no copyright registry in South Africa because there is no registration requirement for obtaining copyright protection. This said, I believe there is a registry for cinematograph films. It may be worth double-checking with CIPC (http://www.cipc.co.za<http://www.cipc.co.za/>) though. A possible way forward could be to also get in touch with the relevant collecting society (eg, DALRO for literary works) as the creator may have an agreement with them.

I've tried to find a central SA Copyright Office where I can check who the copyright for items belong to. There is no contact info at WIPO  http://www.wipo.int/directory/en/contact.jsp?country_id=190&type=ADMIN_CR

Do we have such a copyright registry in SA?
